1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Snoutique ("we," "us," or "our"), governing your access to and use of the website located at snoutique.shop (the "Site"), including any purchases made through the Site.

By accessing or using the Site, creating an account, placing an order, or subscribing to our newsletter, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and our Returns & Exchanges Policy, all of which are incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the Site or make any purchases.

2. Eligibility

You must be at least 18 years of age to make a purchase on the Site or create an account. By placing an order or creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are under 18, you may browse the Site but must not make purchases or create an account without the involvement and consent of a parent or legal guardian.

In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.

3. Account Registration and Security

You may create an account using an email address and password or through Google OAuth authentication. Account creation is optional — guest checkout is available for all purchases.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately at support@snoutique.shop if you suspect any unauthorized access to or use of your account.

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a manner that could harm Snoutique, our customers, or third parties.

You may delete your account at any time through your account settings. Account deletion is permanent and irreversible — all personal data, saved addresses, and coupon assignments will be removed. Order records required for legal, tax, or accounting compliance will be anonymized rather than deleted, in accordance with our Privacy Policy.

4. Products and Pricing

All Snoutique products are custom-made to order through our print-on-demand fulfillment partner. We do not carry pre-manufactured inventory. Each item is produced individually based on your selected customization options (such as design, color, size, and personalization text where applicable).

All prices are listed in United States Dollars (USD). Prices are subject to change without notice, but any price changes will not affect orders that have already been placed and confirmed. We make every effort to ensure pricing accuracy; however, if an error in pricing occurs, we reserve the right to cancel the order and issue a full refund.

Product images on the Site are representative mockups and may vary slightly from the final delivered product in terms of color, texture, or placement due to the nature of custom manufacturing, differences in screen displays, and print-on-demand production processes. Such variations do not constitute defects.

5. Orders and Payment

By placing an order, you are making an offer to purchase the selected products. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, suspected fraud, or violations of these Terms.

Payment is processed securely through PayPal. Accepted payment methods include PayPal, major credit and debit cards (Visa, Mastercard, American Express, Discover), and PayPal Pay Later options where available. We do not store your credit card or payment information — all payment data is handled exclusively by PayPal in accordance with their security standards and terms of service.

All prices are verified server-side against our product catalog at the time of checkout. The total amount charged will include the product price(s), applicable shipping fees, and any discounts applied through valid coupon codes. There are no hidden fees.

Once your payment is successfully captured, your order is submitted to our fulfillment partner for production. Because all products are custom-made, orders generally cannot be modified or cancelled once submitted to production. If you need to make a change, contact us at support@snoutique.shop as soon as possible and we will do our best to accommodate your request, though we cannot guarantee changes after production has begun.

6. Shipping

We currently ship only within the United States. A flat shipping rate of $6.99 applies to all orders. Orders with a subtotal of $75 or more (after applicable discounts) qualify for free standard shipping.

Estimated delivery times are provided as guidelines and are not guaranteed. Delivery estimates include production time (typically 2–5 business days) plus transit time (typically 2–4 business days). Actual delivery times may vary due to carrier delays, weather, high-demand periods, or other factors beyond our control.

7. Returns, Exchanges, and Refunds

Because all products are custom-made to your specifications, we do not accept returns for change of mind or incorrect customization choices. Please review your selections carefully before placing your order.

We will provide a free replacement or full refund for items that arrive damaged, defective, or materially different from what was ordered. Claims must be submitted within 30 days of delivery with photographic evidence. Refunds are issued to the original payment method within 3–5 business days of claim approval.

For lost packages confirmed by the carrier, we will reship the order at no additional charge. For full details, please review our Returns & Exchanges Policy.

8. Coupons and Promotions

We may offer promotional coupon codes from time to time. Unless otherwise stated, coupons are subject to the following conditions:

• One coupon code may be applied per order
• Coupons cannot be combined with other offers unless explicitly stated
• Coupons may have minimum order requirements, expiration dates, and usage limits
• Each coupon may be used only once per customer account
• Coupons have no cash value and are not redeemable for cash
• We reserve the right to void or revoke coupons at any time if misuse, fraud, or technical error is detected

Post-purchase promotional offers are time-limited and available only during the specified offer window. Pricing and availability of promotional offers are subject to change and may be withdrawn at any time without notice.

9. Intellectual Property

All content on the Site — including but not limited to product designs, artwork, illustrations, embroidery patterns, logos, brand names, text, graphics, photographs, product mockups, icons, page layouts, and software — is the property of Snoutique or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or commercially exploit any content from the Site without our prior written consent, except as necessary for your personal, non-commercial use (e.g., viewing products for purchase). Any unauthorized use of our intellectual property may result in legal action.

The Snoutique name, logo, and all related product names, design names, and slogans are trademarks of Snoutique. You may not use these marks without our prior written permission.

10. User Conduct

You agree not to use the Site in any manner that:

• Violates any applicable local, state, national, or international law or regulation
• Infringes upon the rights of any third party, including intellectual property rights
• Involves the submission of false, misleading, or fraudulent information (including but not limited to fake names, addresses, or payment details)
• Attempts to interfere with, disrupt, or compromise the integrity or security of the Site, its servers, or connected networks
• Involves the use of automated scripts, bots, scrapers, or similar tools to access the Site or extract data without our prior written consent
• Abuses promotional offers, coupons, or referral programs through the creation of multiple accounts, fraudulent claims, or other deceptive practices
• Harasses, threatens, or harms Snoutique employees, representatives, or other customers

We reserve the right to take appropriate action against any user who violates these restrictions, including account termination, order cancellation, and referral to law enforcement authorities where applicable.

11. Newsletter and Communications

By subscribing to our newsletter, you consent to receive marketing emails including promotional offers, new product announcements, and exclusive discounts. You may unsubscribe at any time using the unsubscribe link included in every marketing email.

By placing an order, you consent to receive transactional emails related to your purchase, including order confirmations, shipping notifications with tracking information, and delivery updates. These transactional communications are necessary for order fulfillment and cannot be opted out of while an order is active.

12. Third-Party Services

The Site relies on third-party service providers to operate. These include, but are not limited to:

• PayPal — payment processing. Your use of PayPal is subject to PayPal's own terms of service and privacy policy.
• Printful — print-on-demand production and fulfillment. Your shipping information is shared with Printful solely for order fulfillment.
• Google (via Supabase) — authentication for account creation and login via Google OAuth.

We are not responsible for the practices, content, or terms of any third-party services. Your interactions with third-party providers are governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party services you interact with through the Site.

13. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that product colors, textures, or dimensions will exactly match the representations shown on the Site due to variations in screen displays and the inherent nature of custom manufacturing processes.

While we strive for accuracy, we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. In the event of a material error, we will make reasonable efforts to correct it and, where applicable, notify affected customers.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Snoutique and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to, use of, or inability to access or use the Site
• Any conduct or content of any third party on or related to the Site
• Any products purchased through the Site
• Unauthorized access, use, or alteration of your transmissions or content
• Delays or failures in delivery caused by shipping carriers or fulfillment partners

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Site exceed the total amount you paid to Snoutique for purchases during the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Snoutique and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content or information you submit through the Site.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles.

Informal Resolution: Before filing any formal dispute, you agree to first contact us at support@snoutique.shop and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved quickly through our customer support team.

Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in the State of Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Snoutique.

Exceptions: Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Additionally, claims within the jurisdiction of small claims court may be filed in small claims court in the State of Florida.

17. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page. For material changes that significantly affect your rights, we will make reasonable efforts to notify registered users via email. Your continued use of the Site after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Site.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Exchanges Policy, constitute the entire agreement between you and Snoutique regarding your use of the Site and supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter hereof.

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition. Any failure by Snoutique to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
